1. Agreement to Terms

1.1

These Terms of Service constitute a legally binding agreement between you and LKQ Electriq (“the Company“), located at Cecil Pashley Way, Shoreham-by-Sea, BN43 5FF, United Kingdom, regarding the use of our services. By utilising our services, you confirm that you have read, understood, and agree to be bound by these Terms of Service.

1.2

The Company provides inspections, diagnostics, and repair work, specialising in electric and hybrid vehicles. By using our services or booking work with us, you agree to all terms outlined in this document. If you do not agree, you must discontinue use of our services immediately.

1.3

The Company reserves the right to update these Terms of Service without prior notice. Any changes will be indicated by an updated “Revised” date and will take effect immediately upon publication. Continued use of our services constitutes acceptance of these changes.

2. Booking and Cancellation Policy

2.1

A full deposit is required at each stage of the repair process to confirm your booking and secure the necessary parts and resources. The amount will be clearly communicated before work begins and must be paid in full prior to commencement of that stage.

2.2

For bookings requiring a deposit, up to the first £500 of the deposit is non-refundable for cancellations or booking changes made within 7 days of the scheduled date.

2.3

If a booking requiring a deposit is rescheduled within 7 days of the original date, any refund of the deposit will be at the discretion of management, and a new deposit may be required to secure the rescheduled date.

2.4

Special order items (including, but not limited to, bespoke parts or items sourced specifically for your vehicle) require an additional non-refundable deposit at the time of order. This is separate from and in addition to any booking deposit paid.

2.5

Cancellations or changes must be communicated to the Company in writing or via email to be considered valid.

3. Payments and Charges

3.1

Full payment for all services is due upon completion of the work unless otherwise agreed in writing.

3.2

LKQ Electriq reserves the right to charge interest on overdue payments at a rate of 4% above the Bank of England base rate.

3.3

Customers must collect their vehicles within 7 days of the completion of the agreed work. Failure to do so will result in storage charges of £20 + VAT per day, beginning on the 8th day after completion.

3.4

Vehicles will not be released until all outstanding payments, including storage charges, are settled in full.

4. Vehicle Collection and Delivery

4.1

LKQ Electriq offers a vehicle collection and delivery service. Customers must ensure the vehicle is accessible at the agreed time and location.

4.2

The Company reserves the right to decline to collect or deliver a vehicle if it is found to be in an unsafe condition. In such cases, it will be the customer’s responsibility to arrange an alternative method of transport for the vehicle.

4.3

Any additional costs incurred due to the vehicle being inaccessible will be charged to the customer.

5. Vehicle Recovery Service

5.1

LKQ Electriq offers vehicle recovery services for vehicles that are immobile or require transportation to the Company’s premises. Recovery fees will be quoted at the time of booking.

5.2

Depending on the distance and time required to complete the recovery service, payment of recovery fees may be required in advance. This will be communicated at the time of booking.

5.3

If a recovery is declined due to the vehicle being deemed unsafe to transport, charges for attending the vehicle will still apply.

5.4

The Company is not liable for delays in recovery caused by circumstances beyond its control, including but not limited to traffic conditions, adverse weather, or vehicle access issues.

6. MOT and Compliance

6.1

Vehicles submitted for an MOT test are assessed under DVSA guidelines. Failure of an MOT may result in the vehicle being deemed unroadworthy.

6.2

If a customer wishes to take a vehicle considered unroadworthy off-site, LKQ Electriq will require them to sign a declaration acknowledging that they are knowingly driving a vehicle deemed unroadworthy.

6.3

It is the customer’s responsibility to ensure their vehicle is roadworthy and complies with UK legal requirements. The Company is not liable for fines, penalties, or enforcement actions arising from the vehicle’s non-compliance.

7. Repair Procedures

7.1

In some cases, repairs may be subject to additional charges above the original quote due to mitigating circumstances, such as corrosion or seizure. Customers will be contacted as soon as possible to be informed of these costs.

7.2

If contact cannot be made, LKQ Electriq reserves the right to make a fair choice to either continue with the repairs or abort the operation in the customer’s best interest.

7.3

Diagnostic repairs are conducted in a logical order as evidence is presented. Vehicles may have more than one issue that is obscured or hidden, which LKQ Electriq cannot predict or be held responsible for.

8. Parts, Repairs and Warranties

8.1

Any parts fitted by LKQ Electriq will carry the manufacturer’s warranty. The Company is not liable for manufacturer defects beyond the warranty period.

8.2

LKQ Electriq will not guarantee or accept liability for used or customer-supplied parts. Customers providing parts do so at their own risk, and additional charges may apply if parts are incompatible or faulty.

8.3

Vehicles used for racing, off-road activities, or other extreme conditions are excluded from warranty coverage.

9. Warranty and Liability

9.1

LKQ Electriq will not be held liable for any consequential or incidental damages arising from vehicle repairs, unless caused by proven negligence.

9.2

Vehicles are left and parked on the Company’s property entirely at the owner’s risk unless the vehicle is under the direct control of a Company employee. While under the employee’s direct control, the Company’s insurance coverage will take effect.

9.3

Onboard recording devices (e.g., dash cameras) will be disconnected by the Company for insurance purposes. Customers are encouraged to disconnect these devices themselves to prevent accidental damage. The Company will not be liable for any damage caused during handling.

9.4

LKQ Electriq is an active work environment, and customers must observe all safety warnings. Injuries resulting from failure to comply with these warnings are not the responsibility of the Company.

9.5

Customers are only permitted in the designated waiting areas. Entry to the workshop or restricted areas is prohibited unless accompanied by a member of staff.

9.6

Consequential Damage Due to Battery Depletion: LKQ Electriq will not be liable for any damage resulting from the battery being allowed to run flat or becoming deeply discharged after being left in our care for an extended period. The customer understands that, if left uncharged for a prolonged duration, the EV/Hybrid/12v battery may suffer permanent damage, including but not limited to capacity loss, failure to hold a charge, or malfunction.

9.7

Prolonged Absence and Battery Risk: It is the responsibility of the customer to inform LKQ Electriq of any anticipated extended absence or prolonged periods in which the vehicle will not be in use. Should the customer fail to make such arrangements and the battery is left to discharge completely or near completely, the customer accepts full responsibility for any consequential damage, repair costs, or loss of value associated with the battery.

10. Call Recording

10.1

All inbound and outbound calls are recorded for training and monitoring purposes.

10.2

Recorded calls are stored securely and used only for the purposes stated above, in compliance with GDPR.

11. Environmental Policy

11.1

LKQ Electriq is committed to environmentally responsible waste management. A disposal charge may apply for the recycling or safe disposal of battery components, vehicle parts, oils, and other hazardous materials.

11.2

A tyre disposal fee applies for the recycling of old tyres, in line with UK environmental regulations.

12. Data Protection (GDPR)

12.1

LKQ Electriq Ltd is committed to protecting your privacy in compliance with the General Data Protection Regulation (GDPR).

12.2

Connected vehicle data may be temporarily accessed or stored for diagnostic purposes. All data will be deleted once no longer needed.

12.3

Customers may request access, corrections, or deletions of their personal data by contacting info@cedarelectric.co.uk.

13. Complaints

13.1

LKQ Electriq aims to provide a high standard of service. Complaints can be directed to chris@lkqelectriq.co.uk or by calling 01903 924872.

13.2

Complaints will be acknowledged within 3 working days and resolved promptly.

14. Governing Law

14.1

These Terms of Service are governed by the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
